Application of discharge for the double murder accused ‘Malehlohonolo Scott was dismissed this week.

‘Malehlohonolo is charged alongside her son Lehlohonolo Scott.

They were arrested on July 12, 2012, following the discovery of Seetsa and Mohata’s mutilated bodies in Koalabata. The mutilation of the bodies led to speculation that the two had been killed for ritual purposes.

In addition to murder, Lehlohonolo Scott also faces the charge of unlawful escape from Maseru Central Prison on 14 October, 2012 while awaiting trial.

After almost two years on the run, Scott was arrested in Durban, South Africa on 6 April 2014 and lost his fight against extradition in the Verulam Magistrate’s Court on 5 May, 2015.

He was extradited to Lesotho on 21 October 2015, where he awaits finalisation of his trials in custody.

For her part, ’MaScott was released on stringent bail conditions in August 2013.

‘Malehlohonolo applied to be discharged from the murder charges with her lawyer Thulo Hoeane citing she was not guilty.

When throwing the application out, Justice Teboho Moiloa said ‘Malehlohonolo was denied application of discharge because he cannot accept the evidence that was presented by her lawyer.

He indicated that he didn’t agree with Hoeane that ‘Malehlohonolo didn’t know anything about the body parts found in her home.

“The body parts were found in ‘Malehlohonolo Scott’s house at Koalabata, of which her son Lehlohonolo Scott claimed that the land belonged to him and not his mother’s.

“According to my speculation, by the time the land was acquired, Lehlohonolo was too young, and in this country sites are allocated to adults. The police found the body parts in the house of the accused ‘Malehlohonolo.

“When you enter the accused’s house, you use the front door into the store room. The second room is the boys’ room that was used by Lehlohonolo and his younger brother, Khotso. The third room was used by ‘Malehlohonolo, then it is a kitchen and a sitting room.

“One of the exhibit found was a bloody card board. There was a suggestion that the accused ‘Malehlohonolo had no access to the rooms. The evidence proved that she has access to all the rooms. In that case, I cannot accept the evidence that she had no idea that there were body parts in that house,” the judge said.

He noted that the other evidence was of the body parts that were found in a car usually used by Lehlohonolo on a daily basis.

Moiloa charged that the evidence points out that the body parts were found in the house and in the car.

“Malehlohonolo cannot say she could not even smell something weird or even notice the flies around that room,” Justice Moiloa said

He further indicated that ‘Malehlohonolo should also give an explanation of the blood found by the police in the toilet.

“She used the toilet, so she cannot say she did not see blood in it. For all those reasons of evidence ‘Malehloholonolo was denied an application of discharge.

Moiloa explained that according to Scott’s lawyer, she did not appear before the court this week because she is critically ill.

“We are hoping to see her on the following dates that have been set,” Judge Moiloa said.

The application was dismissed and the case will continue on the June 18-21 and August 13-16.
